CalRecycle is the California Department of Resources Recycling and Recovery. It is the state agency that oversees California’s recycling and waste reduction programs, including the Covered Electronic Waste (CEW) Recycling Program. This program was established under the Electronic Waste Recycling Act of 2003 and covers electronic devices such as televisions, computer monitors, and laptops. If you’re unfamiliar with how e-waste recycling works at a broader level, it’s worth understanding the process before looking at California’s specific certification rules.

Any organization that collects or recycles covered electronic waste in California and wants to receive state recycling payments must first obtain CalRecycle approval. Without it, a company cannot legally participate in the CEW Recycling Program.

Who Needs CalRecycle Certification?

CalRecycle certification applies to three groups:

  • Collectors – organizations that collect covered electronic waste from consumers or businesses and deliver it to an approved recycler
  • Recyclers – organizations that process and recycle covered electronic waste at a qualified facility
  • Dual Entities – organizations that perform both collection and recycling

ITAD companies, electronics recyclers, e-waste handlers, and refurbishers operating in California all fall within the scope of this program.

Certification Requirements

Before applying, all prospective participants must review CalRecycle’s statutes and regulations and meet the following requirements:

  • DTSC compliance – Recyclers and dual entities must register with the Department of Toxic Substances Control (DTSC), pass a facility inspection, and comply with California’s hazardous waste handling laws before applying to CalRecycle. DTSC also conducts annual inspections for active participants.
  • Operational readiness – Applicants must have an active facility with a valid address and authorized signatories in place.
  • Accurate records – All application information must be current. Any changes to facility location, operational status, or authorized signatories must be reported to CalRecycle promptly.
  • Payee Data Record – Recyclers and dual entities must submit a completed STD 204 Form with their application for payment processing purposes.

Approved applications are valid for two years. Participants must reapply at least 90 days before their approval expires to avoid a lapse in certification.

CalRecycle certification works alongside — not in place of — other industry standards like R2v3 certification, so California businesses should confirm a recycler holds both before signing a contract.
